Terms & Conditions
These Terms & Conditions apply to photography services provided by Michelle Morris trading as The Confidence Photographer (“the Photographer”). The person or organisation booking the photography services is referred to as “the Client”.
By confirming a booking and making any payment due, the Client agrees to these Terms & Conditions.
1. Booking and Payment
A booking is confirmed once the agreed photography fee has been paid, unless otherwise agreed in writing.
The photography fee covers the services set out in the booking confirmation or invoice, including the photography session and the edited digital images specified as part of the chosen service.
Any additional services or costs will be agreed with the Client in advance.
2. Location and Additional Costs
The photography fee does not include third-party costs specific to the shoot unless these have expressly been included in the agreed fee.
These may include venue or location hire, photography permits, admission charges, parking, travel outside any area included in the agreed photography fee, or other expenses incurred specifically for the Client’s shoot.
Where additional costs are required, these will be discussed with the Client in advance and will only be incurred with the Client’s agreement.
3. Planning and Client Preparation
For Personal Branding and other shoots involving a planning consultation, the Client may be asked to provide information before the planning call, including a vision board, initial shot list and any other information reasonably required to plan the session.
The Photographer will provide guidance on matters such as locations, clothing, styling and the overall photographic approach.
While every reasonable effort will be made to incorporate requested photographs, locations and ideas, the Photographer cannot guarantee that every individual requested image will be created.
4. Photography and Creative Approach
The Photographer retains creative and artistic discretion over the photography, including composition, lighting, location, posing, image selection and editing.
The Photographer works predominantly with natural light and will make decisions during the shoot according to available light, weather, surroundings and other conditions on the day.
The Client acknowledges that photography is a creative service and that the final images will reflect the Photographer’s established photographic style.
5. Image Selection and Editing
The Photographer will select and professionally edit the photographs considered suitable for delivery.
Unedited photographs, RAW files and rejected images are not supplied.
Where the booked service includes all edited images, the Client will receive all photographs selected by the Photographer as suitable for final delivery.
The number of photographs produced will vary according to the nature of the shoot and no specific minimum number is guaranteed unless agreed in writing.
6. Delivery
Final edited photographs will normally be supplied through a private online gallery.
Indicative delivery times will be provided at the time of booking. These are normally approximately:

3 working days for Headshot sessions; and
-
5 working days for Personal Branding and Confidence Shoots.
These timings are estimates rather than guaranteed deadlines unless a particular delivery date has been agreed in writing.
The Photographer will inform the Client as soon as reasonably possible if an unexpected circumstance is likely to cause a significant delay.
7. Copyright and Client Licence
Copyright in all photographs remains with Michelle Morris trading as The Confidence Photographer unless copyright is expressly transferred in writing.
The Client is granted a licence to use the final edited photographs supplied as part of the booking.
For personal clients, this includes personal use and sharing on personal websites and social media.
For Personal Branding, Headshot, corporate and professional-services clients, the licence includes use by the Client for their own business and professional purposes, including websites, social media, LinkedIn, PR, editorial coverage, presentations, marketing materials and other communications promoting the Client or the Client’s organisation.
The Client may not sell, license or otherwise supply the photographs to third parties for their independent commercial use without the Photographer’s prior written agreement.
Photographs may not be materially altered, subjected to filters or edited in a way that significantly changes the Photographer’s work without prior agreement. Reasonable cropping and resizing for different platforms is permitted.
8. Photographer’s Use of Images
The Photographer will not assume that every Client wishes their photographs to be used publicly.
Where the Photographer wishes to use identifiable photographs from a shoot on her website, portfolio, social media, advertising, editorial features, awards submissions or other promotional materials, appropriate permission will be obtained from the Client.
A Client may decline permission without this affecting the photography service they receive.
Where the Client is booking photography on behalf of employees, team members or other individuals, the Client is responsible for obtaining any permissions or consents required from those individuals in connection with the photography and its intended use.
9. Client Cancellation
If the Client needs to cancel a confirmed booking, they should notify the Photographer as soon as possible.
The following cancellation terms will normally apply:

More than 14 days before the shoot: any photography fee paid will be refunded in full, less any non-refundable third-party costs already incurred with the Client’s agreement.

Between 7 and 14 days before the shoot: £150 may be retained to reflect planning, consultation and preparatory work already undertaken, together with any agreed non-refundable third-party costs.

Less than 7 days before the shoot: up to 50% of the photography fee may be retained, together with any agreed non-refundable third-party costs.

Less than 48 hours before the shoot or failure to attend: up to the full photography fee may be retained where this reasonably reflects the Photographer’s actual loss.
Any cancellation charge will reflect the Photographer’s reasonable losses arising from the cancellation, including work already undertaken, expenses incurred and the loss of the reserved shoot date.
Where the Photographer is able to rebook the cancelled date, this will be taken into account when calculating any amount retained.
Where appropriate, the Photographer may offer the Client the option of rescheduling rather than cancelling.
10. Postponement and Rescheduling
If the Client needs to postpone a shoot, the Photographer will wherever reasonably possible offer the option of moving the booking to another available date rather than cancelling it.
One change of date will normally be accommodated without an additional photography fee, provided reasonable notice is given.
Any payments already made will be transferred to the new date.
If the Client requests a postponement at very short notice, or postpones the booking more than once, the Photographer reserves the right to charge a reasonable additional fee to reflect any costs or losses arising from the change.
Any non-refundable third-party costs already incurred, such as venue or location hire, permits or admission charges, will remain payable by the Client. If these costs can be transferred to the new date, they will be.
Where a shoot needs to be postponed because of unsuitable weather, illness, emergency or another genuine unforeseen circumstance, the Photographer will make every reasonable effort to agree a suitable alternative date.
If the Client ultimately decides not to reschedule and instead cancels the booking, the Client Cancellation terms will apply.
11. Weather
Many shoots take place outdoors or use natural light and may therefore be affected by weather conditions.
If the Photographer considers that the weather would significantly compromise the quality of the photographs or make the shoot impractical or unsafe, the Photographer and Client will agree an alternative date wherever reasonably possible.
There will be no additional photography fee for rescheduling a shoot where postponement is agreed because of unsuitable weather.
However, third-party costs that cannot be refunded or transferred may remain payable by the Client.
12. Cancellation by the Photographer
If the Photographer is unable to carry out the shoot because of illness, injury, emergency or another circumstance outside her reasonable control, she will endeavour to agree an alternative date with the Client.
If rescheduling is not possible or acceptable to the Client, payments made for photography services that have not been provided will be refunded.
The Photographer will not be responsible for consequential or indirect losses arising from such cancellation to the extent permitted by law.
Nothing in these Terms & Conditions affects the Client’s statutory rights.
13. Events Beyond Reasonable Control
Neither party will be responsible for failure or delay caused by circumstances genuinely outside their reasonable control, including extreme weather, serious illness, transport disruption, venue closure, government restrictions or similar events.
Where such circumstances affect a shoot, the Photographer and Client will work together in good faith to arrange an appropriate alternative wherever possible.
14. Technical Failure
The Photographer takes reasonable precautions with photographic equipment, image storage and backup systems.
In the very unlikely event that images are lost or unusable because of complete equipment failure, data corruption or another technical problem outside the Photographer’s reasonable control, the Photographer will offer an appropriate remedy depending on the circumstances, which may include a reshoot or refund of the relevant photography fee.
Nothing in this clause excludes liability where it would be unlawful to do so.
15. Safety
The Photographer will take reasonable care when selecting locations and working during the shoot.
Clients remain responsible for their own personal safety and for making reasonable decisions about clothing, footwear, locations and activities.
The Photographer will not ask a Client to undertake an activity that she considers unsafe and reserves the right to stop or modify a shoot where conditions become unsafe.
16. Locations and Permissions
Where photography takes place at a privately owned or controlled location, permission may be required.
The Photographer will discuss any known requirements with the Client during planning.
Where the Client specifically requests a venue or location, the Client may be responsible for obtaining permission and paying any associated charges unless otherwise agreed.
The Photographer cannot guarantee continued access to a particular location where access is controlled by a third party.
17. Personal Belongings
The Photographer cannot accept responsibility for loss of or damage to personal belongings during a photography session unless caused by the Photographer’s negligence.
18. Complaints
If the Client has any concerns about the service provided, they should contact the Photographer as soon as reasonably possible.

The Photographer will aim to respond within 5 working days and will make reasonable efforts to resolve any concerns fairly.
19. Changes to the Booking
Any significant change to the agreed scope of a shoot may require an adjustment to the photography fee.
This might include substantially extending the duration of the session, adding additional people or locations, or changing the nature of the photography required.
Any additional charge will be discussed and agreed with the Client before the additional work is undertaken.
20. Privacy
Personal information supplied in connection with a booking will be handled in accordance with the Photographer’s Privacy Policy and applicable UK data protection law.
21. General
These Terms & Conditions, together with the Client’s booking confirmation or agreed proposal, form the agreement between the Photographer and the Client.
Any variation should be agreed in writing.
If any individual provision of these Terms & Conditions is found to be unenforceable, the remaining provisions will continue to apply.
These Terms & Conditions are governed by the law of England and Wales, subject to any rights a consumer may have under applicable law.
